General terms and conditions EPS fertilizers (March 2022)
Article 1: identity
EPS fertilizers is a webshop specialized in plant nutrition. EPS fertilizers is registered in the trade register under number 65428889. EPS fertilizers is located in Zoetermeer at Willem Dreeslaan 141.
Article 2: applicability of the general terms and conditions
These general terms and conditions apply to all offers, quotations and agreements between EPS fertilizers and a counterparty. The application of other general terms and conditions, for example those used by the other party, is expressly excluded.
Article 3: conclusion of the agreement
All quotations and offers of EPS fertilizers are without obligation unless explicitly stated otherwise. An agreement is only concluded after acceptance of an order by EPS fertilizers. An order is deemed to have been accepted if EPS fertilizers has not indicated that it does not accept it within 14 days of placing the order. An order is also deemed to have been accepted if the other party has received an order confirmation for EPS fertilizers.
Article 4: payment
This is done when ordering via the webshop.
Article 5: right of withdrawal
1. If the agreement between EPS fertilizers and the other party is an agreement as referred to in Section 9A of Book 7 of the Dutch Civil Code, the other party has the right to dissolve the agreement within fourteen days after delivery of the purchased goods. To this end, the other party must send an email message to eps@kpnmail.nl, in which the other party indicates that it will revoke the agreement.
2. The other party undertakes to handle the purchased item with care during the fourteen days within which revocation is possible. In the event of withdrawal, the other party must return the product to EPS fertilizers in its original packaging and – if reasonably possible – in its original condition.
3. The shipping costs as well as the costs for the return shipment are for the other party.
4. In the event of a return, there is no right to a refund of the purchase price, but other goods can be purchased for the same amount. In that case, any shipping costs will be borne by the other party.
5. Revocation is not possible for products that cannot be returned due to their nature.
e.g. Special orders.
Article 6: price
1. EPS fertilizers is entitled to pass on any price changes to the other party. In the case of a consumer purchase as referred to in Article 7:5, first paragraph of the Dutch Civil Code, the other party is entitled to dissolve the agreement within fourteen days after the other party has been notified of the price change.
2. All prices stated by EPS fertilizers are subject to printing, typesetting and typing errors.
Article 7: conformity and warranty
1. EPS fertilizers guarantees that the goods comply with the agreement, the specifications stated therein and the reasonable requirements of soundness. 2. Any defects or incorrectly delivered goods must be reported to EPS fertilizers in writing by the other party within 5 working days, preferably by e-mail.
3. The warranty period for EPS fertilizers corresponds to the warranty period provided by the supplier for the product in question. The warranty is settled by the supplier after the product in question has been returned to EPS fertilizers by the other party.
4. The guarantee does not apply in any case if:
a. The other party has repaired and/or modified the delivered products itself or had them repaired/processed by third parties without the prior written consent of EPS Fertilizers;
b. The delivered products have been exposed to abnormal conditions or are otherwise carelessly treated or are contrary to the instructions of EPS Holland and/or have been treated on the packaging;
c. The defect is wholly or partly the result of regulations that the government has set or will set with regard to the nature or quality of the materials used.
Article 8: delivery
Delivery of the purchased goods takes place by means of delivery on site by shipment. In the event of shipment, the goods will be packaged and delivered by TNT post or a comparable carrier.
